1. Health and Safety
Memories@Sea® excursions at sea are not suitable for:
- Pregnant women;
- Infants/small children ;
- People with existing back problems/injuries/heart complaints ;
- People who have undergone recent surgery;
- People classified as clinically obese;
- People with lower than average mobility;
Passengers must inform Memories@Sea®, prior to booking , of any medical conditions or disabilities that the passenger(s) suffer from or have suffered from prior to booking, in particular, dizziness, epilepsy, lumbar/bone diseases and diabetes (this is not an exhaustive list ).
We do not recommend our boat tours for those who feel anxious at sea, are uncomfortable on boats, or are prone to motion sickness. However, we do advise taking antiemetics or anti-vertigo medication well in advance of the tour departure time (about 30 minutes before departure is ideal).
The health and safety rules given by Skippers must be complied with at all times.
Passengers should bring sunscreen and Memories@Sea® recommends using it 30 minutes before the tour starts.
The life jacket/buoyancy aid must be worn at all times, passengers must sit on the existing seats, hold onto the bars with two hands while the boat is in motion, remain facing forward and remain seated until Skipper says they can move. Refusal to follow the rules may result in the termination of the tour and failure to comply with the rules may result in damages.
Memories@Sea® will not accept any liability for personal injury or damage to third parties and passengers participate entirely at their own risk.
If the vessel has to return to the port/marina due to illness or anxiety of a passenger or weather conditions (this is not an exhaustive list), Memories@Sea® will not be obliged to provide passengers with a refund or a replacement trip.
Replacement trips will only be offered at the full discretion of Memories@Sea®.
Apart from liability for death or personal injury resulting from the negligence of Memories@Sea®, Memories@Sea® shall not be liable for any loss or damage, direct or indirect, howsoever arising, including, without limitation, any distress, inconvenience or anxiety caused during the course of any voyage undertaken and/or during the evacuation of the vessel in the event of a breakdown or accident.
Memories@Sea® cannot be held responsible for weather conditions during your trip.
Please be aware that we do not provide “thrill” or “speed” rides. Our tours are led by skippers who are OCN Accredited Tour Guides and our experiences are designed as family-friendly tours.
2. Bookings
We only work with pre-bookings.
Payment of the deposit guarantees the reservation, non-payment may result in the loss of the preferred date and time.
All prices are in euros and include VAT (Value Added Tax).
A 30% deposit is required for tourist experiences. Our boat only accepts 8 passengers and 2 crew/skippers. The number of passengers booked on each tour must be paid for in full.
The rest of the payment, i.e. the remaining 70%, is due when you meet the skippers on the day of the tour, either in cash to the skipper or by calling 07845370231 before your tour to pay by card.
The principal passenger is responsible for paying the total amount due and any additional amount resulting from accidental or malicious damage caused to the vessel or its equipment by its passengers.
Reservations can only be made by people aged 18 or over.
The use of the cabins/suites on the boat is only available when they are hired for programs lasting more than one day, with an overnight stay on board; however, the existing bathrooms are at the client’s disposal for the entire duration of the tour.
Memories@Sea® does not have bath towels on board, so passengers are advised to bring their own, as well as a bathing suit/shorts and a sweater for late afternoons.
3. Cancellation Policy
3.1. Cancellation by the customer
Up to one week in advance (7 calendar days ) of the scheduled tour, the client can ask to reschedule to another day, according to availability; if he does not want to or cannot, the amount of the reservation will be refunded.
Memories@Sea® reserves the right not to refund the price of the reservation if there is no time before the tour, and will always offer the possibility of rescheduling the tour according to availability.
If the customer arrives late, Memories@Sea® has no obligation to compensate for the delay after the defined end time.
In the event of damage to the boat, Memories@Sea® reserves the right to ask for a deposit of 300€ in order to cover the repairs after the quotation.
Memories@Sea® is not responsible for factors that may cause a passenger to miss their trip, including: transportation delays, weather conditions, parking problems and illness, and no refunds or rescheduling will be given.
Memories@Sea® shall not be liable for any expense, loss of time, disappointment, inconvenience or any other consequential loss suffered by the passenger in the event of cancellation or postponement of a reservation.
3.2. Cancellation by Memories@Sea®
In the event of bad weather conditions that jeopardize the safety of the boat, crew and passengers, Memories@Sea® is free to propose rescheduling or refunding the price of the reservation, up to 12 hours from the time set for the tour.
If the boat breaks down, Memories@Sea® will be responsible for arranging an equivalent or superior boat. If we are unable to do so, we will refund the booking price.
If the sailings are banned by the competent authorities, Memories@Sea® may reschedule or refund the price of the tour, at the client’s discretion.
4. Photography
Memories@Sea® reserves the right to use photographic equipment and/or video recordings and/or other monitoring equipment on the vessel or in the vicinity of the vessel that may feature passengers for advertising or promotional materials, and retains ownership of any intellectual property rights to the photographs and/or video recordings.
If the main crew member does not want photos/video recordings during the tour, please make this clear at the time of booking and we will ensure that our skippers respect your wishes.
Memories@Sea® allows crew members to take their own photographs and video recordings from a seated position only and only when the vessel is stationary. Memories@Sea® is not responsible for the loss or damage of any photographic or video recording equipment during the voyage.
5. Conduct
The skippers’ orders must be followed at all times.
Parents/guardians are always responsible for the children.
The consumption of alcohol on board is prohibited, unless authorized in advance.
No one under the influence of drugs or alcohol is allowed on board.
Smoking is strictly forbidden.
No one who is openly aggressive, verbally abusive or physically threatening will be allowed on board or allowed to stay on board.
The main crew member remains financially responsible for any damage caused to the boat or equipment by their crew group. This includes manually inflating an automatic lifejacket, except when they are expressly instructed to do so by the skipper (this incurs a fee of 150€ for refitting it).
Memories@Sea® allows crew members to bring personal belongings onto the vessel, however Memories@Sea® will not accept any responsibility if any personal belongings are damaged or lost at any time. These must be stowed safely while the ship is in motion. The skipper will decide where they are stowed.
